Warning to Renters
Warning to Renters In 2024-2025, my family rented a property in Rocklin, California managed by Evernest Real Estate Corp. (headquartered in Birmingham, Alabama). Our experience was a nightmare of deposit disputes, fraudulent damage claims, and refusal to honor court orders. The Deposit Dispute We paid a $3,700 security deposit. Evernest later claimed we only paid $3,600. Only after providing our original contract did they acknowledge the correct amount. Damage Claims We Disputed We documented our move-in and move-out with video. We left the home in better condition than we found it. Yet Evernest charged us for: • Wall scuffs we had painted over • A lightbulb that was present in our move-out video AND visible as missing in their own rental advertisement • A patched screw hole that was already visible in their rental listing We Won in Court We took them to court with our video evidence and their own advertisements proving these damages predated our tenancy. The judge ruled in our favor and ordered them to pay. They Refused to Pay For one year, despite winning, Evernest refused payment. We had to return to court. They didn’t show up. The judge reaffirmed our victory. Still no payment. We are pursuing a debtor’s examination to compel Everest Property Management to disclose its banking information so we can enforce the judgment. We will also seek reimbursement for all costs incurred during collection efforts, including filing fees, processing fees, travel expenses, lost wages, and the $500 levy fee incurred while attempting to collect from a bank account they previously used. Do not rent from Evernest Real Estate Corp. Document everything. They will fight legitimate claims and ignore court orders. If you have actually gotten your deposit or any check back from them feel free to contact me on instagram @gina_pustizzi. I have questions.
