Money was taken out of my account unathorized. Put me in huge bind. Not happy with lack pg follow up and credit to my account yook 8 business days.

I received a summons in Feb with a trial date set for 5/18/26. I received a notice that my case was sent to the local attorney representing ELP. I spoke with an attorney on or around April 8 to discuss the two FDCPA I signed back in February against this same collection agency. I asked why the local attorney was asking me about a settlement if I had signed FDCPA against the creditor. I let the ELP attorney know that I've worked with this local attorney before and I don't believe he has my best interest at heart. He gets assigned a case sends you an email and ask what you could afford to pay without trying to settle on a reduced amount. The ELP attorney agreed that the firm should be using the FDCPA against the collection agency to wipe out the debt or we would be going after them for violating my rights. He was so send the local attorney and email with what to say to the law firm representing the collection agency. On 4/22 I received 3 documents in the mail from the court stating the trial for 5/18 was cancelled, a new trial date was scheduled for 6/18 and a notice of intent to defend. With the new trial date I assumed the law firm received a statement regarding the FDCPA. I never heard back from the local attorney or the attorney at ELP. On 6/8 I reached out to the attorney at ELP to find out the status of my case, He said that the local attorney was representing me and he would have him contact me. He also informed me the FDCPA after further digging would harm more than help me. The local attorney called me and said he was going to file a motion of continuance to give us more time. That was filed on 6/8. On 6/12 the local attorney called to let me know it was denied and did I plan on attending the trial on 6/18. I told him know because that wouldn't be enough time for me to put in PTO with my employer and he said I will have to try and find someone to attend. So I asked what had been done with my case since I last spoke to him on April 8 because it appeared as though he dropped the ball representing me. He wanted to now what I could afford to pay and I gave him my offer. He said it was too late to try and negotiate with the trial date on 6/18 but he would see what he could do. I expected to hear back from the local attorney at least by the trial date. On 6/17 I received a document from the court entered an Affidavit Judgement in favor of the plaintiff, The defendant has 30 days from the date of judgment was entered to file a motion to vacate judgement. Also on public record the court noted Defendant FTA default reverted to affidavit judgement. This let me know I was not represented in court by the local ELP attorney or anyone from his office who would be able to represent me. I reached out to the local attorney find out what happen with the negotiation and he said they would't lower the amount but agreed to monthly payments. He then advised me he was going to file a motion to vacate the judgement but couldn't guarantee it would be granted. I paid ELP in full to represent me and failure for them to show up for court during my trial is unacceptable. 7/10/26 As stated before and in response to ELP reply, after speaking with two separate attorney's the beginning of April, my case was in the hands of the local attorney and he did absolutely nothing to represent me or negotiate on my behalf.until I reached out on June 8 when he filed motion for continuance. I didn't hear back from him until June 12 in which he told me his motion was denied, the FDCPA could not be used and he was going to have to find someone to attend court. He said it didn't matter when he filed the continuance, but this isn't correct because there is at least 15 day window in which the plaintiff along with the judge needed to make a decision. He also said today that the motion to vacate has been drafted but he has 30 days from the date the judgement was entered. Even if you call and speak to someone at ELP no one calls you back and the only way they respond is when someone leaves a poor review about their law firm. As you can see from my previous reviews and their responses. So no I don't agree that they met their obligation to represent me when you have 2 months to negotiate with the plaintiff to avoid a trial, wait 7 days before the trial to file a continuance and not represent me at the trial. After speaking with a supervisor on 6/22, as I was told to contact them directly to discuss. I never heard back from the supervisor so I called again and left a message. I was told she would get back to me soon once ELP reviewed my case All I received was an email titled on July 6 FDCPA Misstep from a paralegal. She offered to have an attorney call me and I have yet to speak directly with an attorney who directly works ELP since June 8.

I thought you were helping me with my credit instead im being sued by auto finance and they called mev8 times a week for months you told me that was against the law to be harassed like that. So im not understanding this.

The company made promises that they never fulfilled. Took 3 accounts and sent some letters which only ruined my credit score. Now 3 years later and 19,000 dollars in fees they drop me like a hot potato. I still have the 3 accounts to deal with, I'm 19,000 short and and my credit score is 130 points lower taking all other options away from me
