Dear Rothert, Our sincerest apologies that you are not satisfied with your purchase! Many different variables can alter exactly how long the battery life will last. For example if you are listening to the product on the highest volume, either on your phone or on the Bluetooth® module, you will only receive closer to 7-8 hours of playback. We highly suggest listening to the product at a medium volume level as a high level could cause hearing damage if used for several hours. We have also found that certain apps cause the Bluetooth® module to have a shorter battery life. Through our testing we have found the White Noise app (http://www.tmsoft.com/white-noise) does not cause a shorter battery life. We have also found listening to music preloaded on your device will give you the 10-13 hour battery life. Having the correct size will alleviate the soreness you are experiencing. If you could please fill out the warranty form found on our site and send it in with your headband, we will send you a new headband to insert your speakers into! It is 95% polyester and 5% spandex. We would be happy to exchange the headband for a different size!
