Incorrect Proof of Service Caused My Court Hearing to Be Postponed — No Accountability
I hired One Legal for their Serve & eFile service in August 2026 and paid $125 to have Small Claims documents served on a corporation through its registered agent for service of process. Unfortunately, the Proof of Service prepared and filed by their process server contained a serious documentation problem. On the SC-104/SC-104A paperwork, the process server listed the corporate registered agent's business name in the field intended to identify the individual authorized to accept service. The actual recipient was described only as "Jane Doe," without a properly documented name and authority. At my scheduled court hearing, the judge determined that the filed Proof of Service was insufficient for the named authorized agent of the corporate defendant. As a result, my hearing was continued to December 2026. This caused me significant inconvenience, wasted time, and additional expenses. I now have to arrange and pay for service again. What disappointed me most was One Legal's response. I contacted customer support, explained the issue, and requested that they correct the problem by arranging another service attempt at no additional charge. Instead of taking responsibility for the documentation problem, One Legal refused to provide complimentary re-service and offered only a 25% discount on another order. Even after I escalated the matter, their decision remained unchanged. I understand that process servers cannot guarantee successful service. However, when a customer pays for professional service and court filing, I believe it is reasonable to expect accurate documentation and meaningful assistance when a problem arises. I chose One Legal because it appeared on the Orange County Superior Court's list of approved electronic filing providers. I later learned that this approval relates to electronic filing, not an endorsement of process-serving quality. Based on my experience, I cannot recommend One Legal for process serving, particularly for Small Claims cases involving corporate registered agents. If you use this company, carefully review every detail of the Proof of Service before relying on it for a court hearing.
