This company tries to help you deal…
This company tries to help you deal with disputes with other companies, but whether or not it’s worthwhile seems to depend on just how scammy a company you’re dealing with. People seem to have good luck using FairShake to help with disputes with phone companies, but AirBnB, it turns out, is just too slimy for the service to work. FairShake filed papers for me to take AirBnB to arbitration. I paid a $200 fee to the arbitration company, and then AirBnB told the arbitrator to cancel the arbitration and make me take AirBnB to court anyway. The arbitration company claimed that the fee was non-refundable. Communication with Fairshake throughout the process was poor until I wrote this review. Then a supervisor noticed and took charge and communication improved immensely, though too late to change things. Apparently the arbitration company double charged us for the fee— charged FairShake first, then charged me. Once I disputed the arbitration fee with my credit card, the arbitration company decided to charge the fee to AirBnB “instead”. So until I actually see a refund, it looks like the arbitration company is trying to triple-Bill this same fee! I feel confident that I will at least get my $200 back, probably through my credit card company, and will have to take AirBnB to small claims court to pursue my dispute with them.

Update (7/30): This sounds like a highly unusual situation. I'm going to follow-up with you by e-mail to try to get this sorted out. -Max Update (7/29): Hello, Based on the follow-up details you provided, I can confirm that we *did not* make any charge to your card (though we did securely capture your card details in order to potentially make such a charge). We will not be charging you, and If we had already charged your card we would now refund it given the circumstances. FairShake actually paid up front the $200 to advance your claim into arbitration. (We too hope that Airbnb and the AAA will eventually refund it). We at FairShake continue to look for ways to improve the process for claimants when companies like Airbnb attempt to wrangle out of their obligations under arbitration. **If you are interested in continuing to pursue your claim against Airbnb under arbitration, we have a potential next step for you to make them come back to the table—on the basis that it's really not fair for them to push you out of their own chosen legal process. We can arrange to provide documents pro bono (free) if you would like to try this approach.** -Max Hi Vanyali, Sorry to hear you had an unsuccessful experience -- we take all feedback seriously and want to improve the experience for all of our current and future users. Unfortunately we rely on the contracts of companies like Airbnb, which say they prefer to resolve disputes in arbitration. For a company to then turn around and say "we changed our minds" something we don't see a lot of out of most companies and is pretty sketchy in my opinion. The $200 filing fee you paid is generally refundable, and will be refunded by the American Arbitration Association. I will check on our end if we are able to issue you that refund ourselves in the meantime. (There may be legal complexities that would stop us from doing so.) -Max
