Ashley Homestore is Fraudulent
I purchased furniture in April 2021 from Ochs Brothers Inc dba Ashley Homestore Cape Girardeau, MO. As of January 2022, they still could not deliver my Full Order. Since the Sales Contract does not have a Definitive End Date the contract is technically invalid. Even thought there might be some who argue and say there is a Sales Contract, but it is valid for 30 days only. After that 30 days, the Ochs Brothers should have offered me a Full Refund or ask if I wish to continue to wait, with the right to cancel at any time. When I asked a number of times to cancel my order, I am given the continued excuse of “it’s just an estimate,” I pushed for a reasonable fulfillment date to agree on a full refund, and they just continue to say, “The delivery date is just an estimate.” I have no idea how an indeterminate delivery dates is an acceptable business practice. They say whatever they need to at the point of sale (I chose this specific set because David Hunt told my wife and I that it was currently in stock and could be delivered within 4-6 weeks). Then they say whatever they need in order to string you along (I was told several times, it would just be another 4 weeks). So they get to tell you whatever they want verbally with no accountability, but hold fast to a contract that has an estimated delivery date which they refuse to set a reasonable fulfillment date for. Then when the sales associate and store manager admit they have no idea when they will be able to fulfill the order, they still say the only way to cancel is with a 35% penalty. Where is the reasonableness and consumer fairness in this, much less the integrity? Ochs Family is using Fraudulent Business Practice to Victimize me. Since November 2021, Ochs Family has refused to cancel my order for a Full Refund. When visiting in person, the sales associate, David Hunt and store manager, Sarah King, even acknowledged they had no idea when they would be able to fulfill the order.
