Hello Ellen, We've sent your question over to the process server but the reason there were only 2 attempts and service failed was because the server spoke with an individual who identified themselves as the resident and they stated the subject was unknown. The server also spoke with a property manager/landlord who said Jabesh Seymore was not resident. The server spoke with the current occupant who stated they just moved in. The property manager stated the subject (Jabesh Seymore) is not on the lease and/or not a resident in the unit.

Shawn, Yes. Your case was filed, accepted by the court and service of process has been started (serving the defendant the court summons). Our prices have not been updated since January and before that not for several years. I believe you are referring to the service of process charge. It is cheaper to purchase it along with your original filing as it gets included in our initial triple-check process of verifying all information provided. If purchased after that we have to perform similar tasks again and there is just more human resources involved, so a slightly higher cost is incurred. If you log into your dashboard online (where you can check the status of your case) you will notice that as a Dedicated Case Agent customer (our highest package) there is a button to schedule an appointment. These are done through Google Meet and you can schedule as many of those as you would like to speak directly to a senior member of our case review team. I encourage you to schedule an appointment if you have any questions, concerns or feedback that you would like to share directly with us. In the meantime, I have gone ahead and refunded part of your most recent service of process fees to match the amount you would have paid originally had you selected it as an add-on at the initial checkout.

Calvin, We received your first filed claim on Sunday. We reached out to you on Monday and began working on your claim and assigning a paralegal to your case. We also received another claim for for the same case from you last night with higher claim amounts and an updated explanation provided from you. This means we had to disregard your first claim from 2.5 days ago and we are currently working on your newer claim. We will reach out if there are any issues with your claim or if we need anything such as a document notarized - otherwise your claim will be filed shortly. Your original claim would have likely been filed last night or this morning had we not received a new revised claim from you. Hang tight! We are working on the case to make sure everything is filed correctly.

Kenneth, The process server indeed was not able to locate the defendant. They spoke with the property manager and they indicated they have no knowledge of a resident by the defendant's name. Service of process can be difficult for some defendants. We had recommended that you still appear at your court hearing. The process server provided an affidavit that attested to the attempts made. Sometimes the judge may allow alternate service by mail. However, in this case it seems like that would not have been an option as it was indicated the defendant likely does not reside there. In this case you would have to ask the court for a continuance to allow more time to serve the defendant. This would have required you to look into where the defendant can by physically located.

Sam, Unfortunately we were not able to serve the defendant. The process server tried a total of 6 times (which is 2 more than we contract them to do) and filed an affidavit attesting to the fact that the defendant was avoiding service. In matters like this the two courses of action would be to ask the judge to allow for alternative service by mail and/or get a continuance. I hope you were able to accomplish that and have your day in court! I'm sorry the defendant could be served. It's difficult when they avoid process of service.
