JPG Legal Review
I’ll not add any commentary. Based on the email thread below, you can decide if my rating is warranted. Please note, I was a repeat client, and this was my 2nd trademark order. - Email 1 = On Mar 25, 2021 AM M wrote: Hi DX, I'll go ahead and upgrade to the Safe Package. Is there a new timeline for the application review? MX - Email 5 = From: DX, JPG Legal Sent: May 18, 2021 To: MX @XX Hi MX, I was actually waiting for you to reply to my last email so I can finalize your application. Can you please confirm? Anyway, I assume it's been paid so I went ahead and finalized the application. See filing receipt attached. DX Associate Attorney, JPG Legal - Email 6 = Sent: May 18, 2021 To: DX, JPG Legal DX, I just had a chance to review the application and I saw it is dated May 12th. That means...as I said in a previous email...it has been almost 8 WEEKS! This is a significant problem. I mean, waiting for me to reply to your email with regards to a payment confirmation is no excuse for an 8-week delay with no follow-up on a fully-funded order. Especially with the fact that your office sent me a receipt for my payment. I paid the upgrade invoice the same day it was sent to me on March 26th. Am I to assume no one in your office processed and deposited my payment in the last 8 weeks and there has been no communication within your office with regards to account receivables and updating client orders/accounts. And that leads me to my next question.... when were you going to follow up? I mean...it has been 8 weeks! One week...ok. Two weeks..fine! But 8 WEEKS...really!! If I had not emailed you last week...would my order still be in limbo for 10 weeks....12 weeks..indefinitely! This is unacceptable! This delay will cost me money and time. Based on my previous application, I was expecting everything to be finalized by August/September thereabouts assuming no problems. Now...that deadline is no good and my app timeline is now worthless which will ultimately cost me money. It's going on two days since I emailed you and I haven't heard anything..I’m absolutely livid! The level of apathy that is being displayed regarding my order (A REPEAT UPGRADED ORDER AT THAT) is something I can't put into words right now! How are you going to make this right? This 8 WEEK delay may potentially cost me thousands! And to think ...I was looking to file more applications through your firm...but now. MX - Email 8 = From: DX, JPG Legal Sent: May 21, 2021 To: MX @XX Hi MX, I’m so sorry you felt that way. We always strive to work as efficiently as possible with all of our clients. As a courtesy, I’ve processed a refund of $300. You should receive a separate email regarding the refund before the end of the day. DX Associate Attorney, JPG Legal - Email 9 = On May 27, 2021 MXX wrote: Hello DX, I received the refund, and I took a few days to calm down. But to be frank with you, that $300 won't come close to covering the costs associated with me not being able to launch in Q4. However, I won't belabor the issue; I trusted you and your firm, got burnt, I’ll lose money, and that's that. Moving forward, I’ll not let this happen again. I’ll be contacting you regularly to check on the status of my order. Under the current circumstance, I expect a response within 24 to 48 hours and not the 7 to 10 business days that have been the norm. That being said, please provide me with a new timeline for my application. MX - Email 10 = On May 27, 2021 JX, JPG Legal wrote: MX, I've been following this thread and I've reviewed every email in it. Based on your behavior, I don't think we can work with you anymore so I've refunded you in full through your credit card and through PayPal. We are formally withdrawing as law firm of record with the USPTO. If you'd like representation or any future trademarks, please find a different attorney to work with. JX Response Update -- Due to the character limit, I can't reply as I would like. However, I’ll pose this one question, if I were the type of client described by JPGL, why do a 2nd trademark for me? JPGL's narrative is misleading and parts are simply not true. Framing me and our last transaction as they did is an attempt to discredit my review.
Response from JPG LegalJul 29, 2021
This former client, who I chose to fire and fully refund, has left the same review on every review site. Here is my response again: I started this law firm in part so I wouldn't have to deal with abusive and disrespectful clients. Now that I have five employees, I want the same for them. I have no issues with firing a client who is treating my employees in an unacceptable manner. This client ignored clear instructions from my associate attorney and then blamed the resulting delay completely on the attorney and our firm, in an unnecessarily disrespectful and inconsiderate manner. In his long, belligerent series of emails to my associate attorney, he lied about how he would lose "thousands of dollars" due to not being able to launch late this year, despite having already launched, despite having us file the application under a use-in-commerce basis, despite there being no legal benefit to waiting until registration to launch a product, and despite it being a legal impossibility to reach registration without launching, because the USPTO requires that an applicant's goods or services be on the market before an applicant to reach registration. This client was well aware of all of these things. Regardless, I authorized a $300 refund to the client. The client continued to berate my employee--an attorney who has fifteen years of trademark law experience and who had given substantial free legal advice to this client on this trademark matter before the client paid anything--and the client set forth "expectations" about how my employee would interact with him in the future that essentially ensured that the client would continue to be disrespectful to my associate attorney over the course of the next several months. I'm not going to sacrifice the mental health of my employees or myself for around $1000. I informed the client that we would no longer be able to work with him and I refunded the client in full, adding $874 to the existing refund, meaning a total refund of $1174, meaning we lost money on this transaction and my associate attorney's search report, legal opinion, and filing of the application were not compensated. The client got significant legal work from an experienced attorney for free. We essentially rewarded him for his unacceptable behavior. But it's worth it to me because I want to operate a law firm where our lawyers and support staff know they're not obligated to continue to work with abusive clients.
