Misleading Practices & Refusal to Release UCC
I strongly urge other small business owners to proceed with extreme caution when dealing with Fleetsmarts. Our company, never signed or executed any formal agreement with Fleetsmarts. Despite this, a UCC lien was filed against our business. We have documented proof that no agreement was ever completed, including repeated reminders from Fleetsmarts themselves asking us to sign their initial Card Agreement. At no point was a UCC filing clearly explained, authorized, or signed. The initial onboarding call was even disconnected, and there was no follow-up clarification regarding any lien or security interest. When we requested removal of the UCC, instead of resolving the issue, we were presented with a “Mutual Release Agreement” containing inaccurate statements and conditions requiring us to waive our legal rights, agree not to pursue complaints, and accept a version of events that is not true. They have refused to release the UCC unless we sign this agreement, which raises serious concerns about their business practices. We have since filed complaints with the Connecticut Attorney General’s Office and other regulatory agencies. This experience has been extremely frustrating and concerning. Business owners should be very cautious and ensure they fully understand any terms before engaging.
