After reviewing the agreement in detail, I would strongly advise others to read every line of Fleetsmarts’ contracts before signing. The structure of their agreements ties a fuel credit line to mandatory enrollment in factoring services, even if those services are not actually used. Additionally, the credit line carries a 1-year term with strict notice requirements (95–105 days prior to termination), which significantly limits flexibility. There are also provisions that can create operational and financial restrictions, including: The assignment of accounts as “absolute owner” once submitted for factoring Requirements tied to fuel usage percentages to maintain program benefits Limitations around payment direction through Notice of Assignment terms Additional costs associated with obtaining a letter of release or buyout While some sections state “no long-term commitment,” other parts of the agreement introduce obligations that effectively bind you depending on how the products are structured or used. Overall, the contracts are complex, heavily one-sided, and rely on fine print that may not be obvious upfront. Proceed with caution and ensure you fully understand the long-term implications before entering into any agreement with this company.

Does anyone have any ideas for how to get out of this scam company, Fleetsmart/Blue Water Capital? I am trying to get a release letter from them, but every time I call, they tell me to send a letter to a buyout link. We need to file a lawsuit against this business. I think they are putting a lot of small businesses out of business.

Do NOT do business with FleetSmarts. The reviews here are fake. They have more than 300 complaints on BBB. In my experience, this company contacts new trucking carriers and tries to sell you on different services and promises, clearly aiming to see if you’ll show even a small amount of interest. I clearly said no and never agreed to anything. Despite that, FleetSmarts filed a UCC‑1 lien against my company without any signed contract, without authorization, and without my consent. I did not find out until three months later, when my factoring company called me to explain that they could no longer work with me because FleetSmarts had filed a lien in first position. My factoring company was genuinely saddened when they saw the lien. They told me they were not surprised because FleetSmarts has had a bad reputation for this same unethical practice for years. Once a lien like this is filed, no other factoring company will work with you, which effectively traps you and pressures you into doing business with FleetSmarts or shutting down your operations. Fleetsmarts asks carriers to pay $500 to release them. Although you never asked them or signed anything, or receive any service from them. They will pretend that they have a recording where you agreed. Even when the recording have you saying NO thank you. I have emails, call recordings, and written confirmation from FleetSmarts stating that I never signed any document or agreed to any service. Yet they still filed the lien and refused to remove it. If you are a new trucking company and you hear the name “FleetSmarts,” my advice is simple: hang up immediately. Do not engage. Otherwise, just like me you will be one more added to the 300 complaints they have on BBB.

This company filed a UCC lien against our business (without a signed contract, application, or authorization). Their own representative confirmed that the person they were working with was not the owner and did not have the authority to act on our behalf. The phone numbers used were not associated with us. However, they only filed a lien based on an "expression of interest". This company is a scam company that we are concerned about after we took legal action against them This is very concerning and unprofessional. A UCC filing should never be filed without proper authorization and supporting documentation. We are now taking formal steps to have this lien removed. Be very careful when dealing with this company.
