My small family business installed the flooring in their Alamo Drafthouse & Cinema in Indy. They are refusing to pay the $25,000 final payment including lien fees. They make excuses anytime I happen to reach them. They are making money daily, but can’t pay my family what they owe.

Apart from the rent being extremely high at $3200 per month, they have redacted the lease to state the maintenance responsibility of the tenant to include replacement of a $15000 worth of HVAC when it becomes necessary to be replaced. In our case, the HVAC began to breakdown in June 2023. Same month we moved in. It keeps breaking down at least twice a month and sometimes three times a month. The standard for commercial lease is that tenant maintain fittings and landlord replaces irreparable fixtures and fittings. So when the winter came in this month, we called them and said it was time to replace the HVAC due to the incessant breakdowns. They said we are to replace it according to the lease agreement. Meanwhile, when Ruben Carrillo explained the wordings, he said they will replace and we will maintain. However, when this issue came up, he said we have to replace. Not only that, their recommended HVAC maintenance technician, Alberto Nunez of Nunez Heating and Cooling is in bed with them. He will play you to make you think it is your fault the HVAC is bad. Unfortunately, we got in contact with the previous people who used to be there and they gave a witness that the HVAC had been that way before they moved out. We also have communication records of all the times the HVAC was breaking down and we were calling Nunez. Stay away from Sojos Capital/Sojos Realty/Weston Property Management/Georgetown Property Management. These are their different names they operate with. They are situated in the property that used to be called Lafayette Square Mall at 3919 Lafayette Road, Suite 395, Indianapolis, IN, 46254. Stay away from them. They are greedy and ruthless.
